Washington State Child Support Law

Federally and in Washington, the amount of child support given to the primary guardian is based on the income of both parents. Other factors that determine the amount of money going into child support include the particular needs of your children and their ages.

Our Focus Is Your Child’s Best Interest

Of all the Yakima family lawyers, we at Skyview Law can promise to go above and beyond the rest to put your child’s needs at the forefront of your case. When custody decisions are made in court, a few factors will determine what is in the child’s best interest.

A judge makes decisions based on:

  • How the parents get along with each other and with the child
  • The distance the parents are apart from each other
  • The parents’ abilities to collaborate and make decisions for the child
  • Each parents’ involvement in their child’s education
  • Domestic abuse allegations for either party

Temporary Child Support

Before a final decree of divorce, one of the parties may need temporary child support. To receive money while awaiting the final ruling in Yakima County, the party in need must file a motion for temporary child support, then schedule a hearing with a “Note for Motion Docket” at their clerk’s office. The opposing party must have at least five day’s advance notice and access to all the paperwork before the official hearing.

The Judge will base their decision on the filed documents and listen to a brief oral argument from both sides.

Changing Support

While it is possible to have child support obligations changed, it must be done with a judge’s approval and will only be granted under specific circumstances, such as:

  • A significant change of circumstances
  • There is a time-lapse of more than a year since the last order during which significant financial hardship has come upon the child or either parent.
  • A time-lapse of more than a year has passed since the last order, and the child has transitioned to a new age category.
  • Divorce, custody, or paternity decrees automatically adjust support.
  • A time-lapse of two years during which either parent has experienced an income change.
  • A time-lapse of two years during which state standards or the official economic table have been modified.

What Happens If You Can’t Afford Child Support?

If the parent responsible for child support can’t afford it, they have few options. As the court’s primary responsibility is to the child, they don’t consider the lifestyle or spending habits of the responsible parent.

If the parent has undergone job loss, injury, or a change in circumstances that affect income, they must contact their lawyer or clerk’s office to ask for a modification.
